1. User obligation
Use of this site constitutes your acknowledgement and acceptance of these Terms and Conditions, which take effect on the date on which you first use the site. By accessing, using and/or downloading materials from this site, you agree on your own behalf and on behalf of each entity and person on whose behalf you act to abide by the terms and conditions set forth below. Wingham Wildlife Park reserves the right to change these Terms and Conditions at any time by posting changes online and it is your responsibility to refer to and comply with these terms on accessing the site. Your continued use of this site after changes are posted constitutes your acceptance of these terms and conditions as modified.
If these Terms and Conditions are not accepted in full, you do not have permission to access the contents of this site and therefore should cease using this site immediately.
2. Copyright and Other Intellectual Property
The names, images and logos identifying Wingham Wildlife Park, and associated organisations or third parties and their products and services are proprietary marks of Wingham Wildlife Park, its associated companies and/or third parties.
All copyright, trade marks and other intellectual property rights in this site shall remain at all times the property of Wingham Wildlife Park. In accessing the Wingham Wildlife Park online store, you agree that you do so only for your own personal, non-commercial use. You may not agree to, permit or assist in any way any third party to commercially exploit or modify in any way the material or content without Wingham Wildlife Parks prior written permission.
3. Terms of use
The use of this site is only for lawful purposes, in a manner which does not infringe the rights of or restrict or inhibit the use and enjoyment of this site by any third party. Such restriction or inhibition includes, but is not limited to, conduct which is defamatory, or which may harass, cause distress or inconvenience to any person and the transmission of obscene or offensive content or interruption of the normal flow of dialogue within this site.
4. Disclaimer/Limitation of Liability
This site and the information, names, images, pictures, logos and icons relating to Wingham Wildlife Park and/or any of its associated companies, products and services (or to third party products and services), is provided "AS IS" and on an "AS AVAILABLE" basis without any representation or endorsement being made and without warranty of any kind, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
The information and other materials included on this site may contain inaccuracies and typographical errors. Wingham Wildlife Park does not warrant the accuracy or completeness of the information and materials or the reliability of any statement or other information displayed or distributed through the site (including, without limitation, the information provided through the use of any software). You acknowledge that any reliance on any such statement or information shall be at your sole risk. Wingham Wildlife Park reserves the right, in its sole discretion, to correct any errors or omissions in any part of the site and to make changes to the site and to the materials, products, programs, services or prices described in the site at any time without notice. In no event will Wingham Wildlife Park and/or third parties be liable for any damages including, but not limited to, indirect or consequential damages or any damages including, but not limited to, errors or omissions, indirect or consequential damages or any damages whatsoever arising from use, loss of use, data or profits, whether in action of contract, negligence or other action, arising out of or in connection with the use of the site. Wingham Wildlife Park does not warrant that the functions contained in this site will be uninterrupted or error free or that defects will be corrected or that this site or the server that makes it available are free of viruses or bugs. Wingham Wildlife Park does not represent the full functionality, accuracy or reliability of any material. Wingham Wildlife Park may terminate, change, suspend or discontinue any aspect of this site, including the availability of any features of the site, at any time without notice or liability.
5. Wingham Wildlife Park Products
All products and services mentioned in this site are subject to availability and are available at the sole discretion of Wingham Wildlife Park. Furthermore, all references to Wingham Wildlife Park products and services are intended to apply only in the United Kingdom.
5.1 General admission tickets
In purchasing tickets for entry into Wingham Wildlife Park (an attraction) you enter into an agreement with WIngham Wildlife Park 2008 Ltd. on these Terms which incorporate the “Common Terms” on this website applicable to all transactions.
5.2 Classes of ticket holder

A Child is a person aged from 2 year to 15 years (inclusive).

An Adult is a person aged from 16 to 59 years old (inclusive).

A Concession is a Disabled Person, Senior or Student, with accompanying supporting documents to confirm their entitlement to Concessionary rates.

A Senior is a person aged 60 years or more, with accompanying supporting documents.
-
A Student is any Adult or Senior holding a valid photographic identity card showing they are a current student.
-
A Family is two Adults and two Children.
5.3 Ticket validity

Tickets sold at the Gate are valid only for the date they are purchased.

Tickets sold Online are valid only for 12 months from the date of purchase or where otherwise stated for the date stated upon them.

Tickets do not guarantee car parking entry.

Tickets are non-transferable to other Attractions or persons and may not be resold without the prior written consent of Wingham Wildlife Park.
5.4 Season tickets
A season ticket (also called a membership) is a ticket which allows for unlimited entry to the park for the person named on the ticket for a 12 month period from the time of purchase. Season tickets may be purchased on 2 purchasing options:
5.4.1 One off payment season tickets
One off payment season tickets may be purchased online, on entry to the park or on exit from the park. When buying at the end of a zoo visit to our park, if the ticket is purchased before leaving the grounds a discount equal to the day entry may be given. This discount is only valid under that circumstance and is not valid online. This rate has various price levels such as free carers for disabled visitors, renewal costs and family discounts. Requirements for each are laid out at the point of sale.
5.4.2 Direct debit payment season tickets
Direct debit payment season tickets require an upfront payment of 45% which is followed by 6 equal monthly payments. No renewal or family discounts are valid for this ticket type and this ticket may only be purchased online before your visit. Direct debit payments are handled through the GoCardless payment gateway and are covered by the Direct Debit Guarantee, however please note that in the case of missed payments or cancellation of payments your season ticket will be cancelled with immediate effect and will not work on entry. The direct debit guarantee is as follows:
- The Guarantee is offered by all banks and building societies that accept instructions to pay Direct Debits
- If there are any changes to the amount, date or frequency of your Direct Debit the organisation will notify you (normally 10 working days) in advance of your account being debited or as otherwise agreed. If you request the organisation to collect a payment, confirmation of the amount and date will be given to you at the time of the request
- If an error is made in the payment of your Direct Debit, by the organisation or your bank or building society, you are entitled to a full and immediate refund of the amount paid from your bank or building society - If you receive a refund you are not entitled to, you must pay it back when the organisation asks you to
- You can cancel a Direct Debit at any time by simply contacting your bank or building society. Written confirmation may be required. Please also notify the organisation.
IMPORTANT NOTE
This ticket type becomes valid from 10 days after your purchase date to allow for the initial direct debit to reach us (unless you see the payment leave your bank account sooner).
5.5 Issue of e-vouchers

When your booking has been confirmed your tickets will be dispatched via e-mail to the e-mail address you specified. It is your responsibility to check prior to purchase that the information you have supplied to us in respect of your e-ticket requirements is accurate. We are only responsible for issuing e-tickets in accordance with the information you provide.

Once purchased, neither the person nor Attraction for which an e-ticket has been purchased may be changed.

Payments for e-tickets are non-refundable.

Wingham Wildlife Park reserves the right to charge the normal Attraction entry rates to any person not able to validate their e-ticket in the above manner.

Please note that all ticket prices are subject to change without prior notice and can be vary through different sales channels (e.g. website and at the gate)

Any additional persons wishing to enter with an e-ticket holder will be required to pay the normal Attraction entry rates.
5.6 Animals on display
Wingham Wildlife Park cannot guarantee that all animals will be on show at the Zoos throughout the day. For various reasons, including animal welfare, certain animals may be off show to the public without prior notice.
6. Indemnity
You agree to indemnify and keep indemnified Wingham Wildlife Park from and against all claims, damages, expenses, costs and liabilities arising in any manner from your entry to and use of the site other than in accordance with these terms and conditions.
7. Law and jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England. Disputes arising herefrom shall be exclusively subject to the jurisdiction of the courts of England. Any cause of action you may have with respect to your use of this site must be commenced within one (1) year after the claim or cause of action arises.
If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the law of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction in which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from that clause and the remaining terms and conditions shall survive and continue to be binding and enforceable.
Wingham Wildlife Park makes no representation that materials on this site are appropriate or available for use at other locations outside of the United Kingdom and access to them from territories where their contents are illegal is prohibited. If you access this site from a location outside of the United Kingdom, you are responsible for compliance with all local laws.
8. Events beyond Wingham Wildlife Park’s Reasonable Control
Wingham Wildlife Park will not be held responsible for any delay or failure to comply with its obligations under these Terms if the delay or failure arises from any cause which is beyond its reasonable control. This term does not affect your statutory rights.
9. Waiver
If you breach these Terms and Wingham Wildlife Park takes no action, Wingham Wildlife Park will still be entitled to use its rights and remedies in any other situation where you breach these Terms.
10. Warranty as to Age
You warrant that you are at least 18 years of age and possess the legal authority to enter into any transaction through this website (including instructing us to collect any payments from a payment card or billing account) and to use this website in accordance with the Terms. You agree to be financially responsible for all transactions you undertake through your use of this website (as well as for use of your account by others).
11. Your Information
Please ensure that when making an order the information you provide is correct and complete. If you wish to make any changes to the information you have provided then please inform Wingham Wildlife Park of these immediately. However Wingham Wildlife Park reserves the right not to act on any requested changes unless it would be unreasonable not to act.
11.1 Direct Marketing
We will only contact you by email if you actively consent to this. By consenting to Wingham Wildlife Park emails or opting in to email communications, you grant us permission to use your email address to send you email marketing communication. At any stage you may choose to opt out of such communications.
If you have provided us with your postal address or telephone number we may contact you by post or telephone about our work, unless you have told us that you don’t want to receive this. Before making such calls we will always screen against the Telephone Preference Service (TPS) or, where sending letters, we will always screen against the Mail Preference Service.
Where you are registered with the TPS we will only make calls to you if you have specifically consented to receiving calls from Wingham Wildlife Park or if we need to contact you in reference to a purchase, for example if there has been a problem in processing a payment. Likewise we will only write to you if you are registered with the Mail Preference Service if you have specifically consented to receiving letters from Wingham Wildlife Park.
11.2 Third parties
Wingham Wildlife Park will not sell your data. We will not share your data for marketing purposes unless you have actively consented to this. However, in some circumstances we may need to share your details with a third party for processing. This could be if we run an event in partnership with another organisation and they need your details in order to fulfil your tickets or experience. For example, if you are taking part in a running event with us, we may need to share your details to be able to send your race pack to you. We may also use a third party to process your personal details if we need to send your data to a mailing house in order to fulfil a postal mailing to you, this could include sending you a letter about your membership.
11.3 Enhancing your supporter experience
We may use profiling and screening techniques to ensure that the communications we send you are relevant to you. This allows us to provide an improved experience for our supporters.
When building a profile of our supporters we may analyse geographic and demographic information, as well as your online behaviour and purchase history, to better understand your interests so we can contact you with relevant messages. An example of this would be looking at your location so we can share information about relevant events in your area.

11.4 Your choice
You always have a choice as to whether and how you want to receive communications about our work, products and services and ways you can get involved. If you do not want us to use your contact details to contact you in the future you can opt out of this when we collect your details or at a later time.

11.5 Legal basis for processing your personal data
In some circumstances we will collect and process your personal information using the legitimate interest legal processing basis.
Sometimes, we will need to process your data as it is part of a contract which you have entered into. For instance, if you have booked an event or animal experience with us, then we will need to contact you and take payment to enable us to provide the relevant services under the agreement with you.
However in most circumstances, we will rely on your consent when using your personal data. An example of this would be when we request your consent to receive marketing emails from Wingham Wildlife Park.
11.6 Retention
We hold your information for only as long as necessary for the purpose needed. For example if you have a season ticket with us, we will keep your details for a minimum of 12 months after your membership expires to allow us to process a renewal discount the following year, unless you decide prior to this not to renew your membership and wish for your details to be removed.
11.7 Under 18s
On some occasions we may collect and manage data of under 18’s. We will always aim to manage this data in a way which is appropriate to the age of the child and will only keep this data for the purpose in which it was collected. Children’s data is usually only collected if you hold a Wingham Wildlife Park membership.
We will always try to seek consent from the parent or guardian of the child before collecting and processing this information.
11.8 Keeping your data secure
We always ensure that we have the necessary controls in place to protect the personal data you provide us with.
We carry out regular audits of who has access to data so that we can ensure that your information is only accessed by trained staff.
Wingham Wildlife Park makes every effort to maintain customer confidentiality when securing an online payment. This includes ensuring the security of your credit card details and other personal information. We don’t store your card details on any Wingham Wildlife Park system. All of your personal information is encrypted as it travels over the internet. When you make a booking, you enter a secure internet site (indicated by the letters https:// in the address bar and or a padlock displayed in your web browser). When you make a payment you enter your card details directly into our payment provider’s secure web page. To protect you against credit card fraud (where someone has discovered your credit card details but do not have your card), you will be asked to enter the unique security code printed on the back of your payment card.
Sometimes we use external companies to collect or process your personal data on behalf of Wingham Wildlife Park. We carry out thorough checks on any companies we work with and have a contract in place with each of these companies to ensure that they process your information in line with our expectations.
Some of our suppliers may run their operations outside the European Economic Area (EEA). Although they may not be subject to same data protection laws as companies based in the UK, we will take steps to make sure they provide an adequate level of protection in accordance with UK data protection law. By submitting your personal information to us you agree to this transfer, storing or processing at a location outside the EEA.
If requested we may need to supply your information to the police, regulatory bodies or legal advisors.
We will not share your data with any other third parties unless you have given your explicit consent for us to do so.
11.9 Your right to your personal information
Under the General Data Protection Regulation you have the right to request a copy of the personal information we hold about you. You also have the right to request that we erase any personal information we hold, where WIngham Wildlife Park has no compelling reason to continue processing this data.

We use ‘cookies’ to enhance your experience on our website. Cookies mean that the Wingham Wildlife Park website will remember you for a particular purpose and for a particular length of time.

14. Your Order
When you place an order the cost of items and delivery charges, and estimated timescales for delivery, will be specified in the order acknowledgment email that Wingham Wildlife Park will send to you. Wingham Wildlife Park will try and ensure that the prices and charges listed at the time of order are accurate, but Wingham Wildlife Park cannot accept any liability if the information displayed is incorrect. In the event that an error is made you will be informed by email (sent to the email address you have given us) of the correct price or charge within a reasonable time of Wingham Wildlife Park becoming aware of the error and Wingham Wildlife Park will ask you whether you wish to continue with your order on the basis of the correct information. If Wingham Wildlife Park has not received confirmation from you within a reasonable period of time (in response to Wingham Wildlife Park’s email notification of the error) that you wish to proceed, the order will be cancelled.
15. Payment
When you place an order through this website, this will be an offer by you to purchase the Wingham Wildlife Park shop items displayed in your shopping basket that Wingham Wildlife Park advertised. Wingham Wildlife Park will then send you an acknowledgement email listing the items you have ordered. Payment will be taken from your payment card when your order is completed successfully online. Ownership of ordered items will pass to you on dispatch.
